As joint owners, what should we consider when registering a property?

There are two ways to register the ownership of land/property that is owned by two or more people.

You will own your land/property as either:

  • beneficial joint tenants, where if one owner dies their share of the land/property passes automatically to the other owner or
  • owners tenants in common, where each owner can leave their share of the land/property to someone else in their will.

We cannot advise you about which kind of ownership is best for you. If you are not sure, you should seek legal advice.

Public Guide 18 – Joint property ownership explains the differences between the two kinds of ownership in more detail.
