Scope of this guide

This guide covers delivery of paper applications under the current Proper Office Order. It tells you which Land Registry office you need to send an application to and gives its address. It is intended for use by both the legal profession and members of the public.

This guide does not cover delivery of applications (a) in accordance with a written arrangement made between the registrar and the applicant or between the registrar and the applicant’s conveyancer (usually such an arrangement is incorporated into a customer team agreement) or (b) by electronic means.

1 Introduction

The requirement to lodge a paper application at the proper office, covered by this guide, is set out in article 2 of the current Proper Office Order and r.15(3), Land Registration Rules 2003. An effect of these provisions is that such a paper application is not treated as ‘received’ until it reaches the proper office. Please use the lists in sections 2 English authorities outside London, 3 London authorities and 4 Welsh authorities to find out the proper office for your property.

If an application is not lodged at the proper office it will be forwarded to the correct office but it will not be treated as ‘received’ until it has reached that office. This means that in the case of a substantive application (usually one for registration) or an application for an official search with priority, the priority of the application will be delayed if it is not lodged at the proper office; in all cases processing of the application will be delayed.

You shouldn’t rely on the postal address of a property to ascertain the administrative area that it falls within. Particular care is needed when dealing with properties on the outskirts of London. For example, a property with a postal address of Bromley, Kent, may fall within the London Borough of Bromley.

If your application falls in more than one Land Registry office area, you may send the application to any one of those offices.

In addition, you may make the following applications at the customer information centre of any Land Registry office.

  • Official copies.
  • Official searches.
  • Outline applications.

If you are making your application in person you must make an appointment beforehand, giving us at least 24 hours notice. To make an appointment you can either:

The lists below also include the date(s) when that area became one of compulsory registration. Refer to this if you need to know whether a property should have already been registered, or to find out why a property might not be. The differing dates are due to the fact that compulsory registration has generally been introduced at district authority level. Because of boundary changes and many reorganisations of local government, it is not always easy to find out when a particular area became compulsory.

2 English authorities outside London

Compulsory land registration has been extended piecemeal across the country in a series of Registration of Title Orders.

The list is complex because of several local government reorganisations that have taken place since. This means that many current local government areas have had compulsory registration brought in at different times and, therefore, you may need to refer to former local government areas.

The abbreviations used for former authorities are:

  • CB – county borough

  • MB – municipal borough

  • UD – urban district

  • RD – rural district.

Land Registry advisory policy

We offer advice to our customers through our publications and Customer Support information and through the day-to-day handling of applications.

We provide factual information including official copies of registers, title plans and documents, searches and details of our forms and fees.

We provide procedural advice to explain how the land registration system works and how to make applications correctly. This includes:

  • advice in advance of an application, where this is requested
  • where an application is defective, advice as to the nature of the problem and what options, if any, are available to put it right
  • an approval service for estate layout plans and certain other land registration documents.

There are limits to the advice that we will provide. We will not provide legal advice.

This means that:

  • we will not approve the evidence to be produced in support of a registration application before we receive the application
  • apart from procedural advice, we will not advise on what action to take
  • we will not recommend a professional adviser but can explain how to find one.

We provide advice only about real cases, not about theoretical circumstances. We will not express a view on questions where the law is complex or unclear except where the question arises on a live registration application.

In providing this factual information and procedural advice we will:

  • be impartial
  • recognise that others may be affected by what we say
  • avoid any conflict of interest.
